1. General
1.1 An international flight is a flight performed in the airspaces of any two or more countries.
1.2 Flights in Mongolian airspace are classified as follows:
Scheduled flights
Non-scheduled flights
1.3 Scheduled and non-scheduled flights in the airspace of Mongolia shall be operated in accordance with the flight permit issued by the Civil aviation authority of Mongolia (hereinafter referred to as “CAA”).
1.4 The Air traffic flow management division (here in after referred to as “ATFMD”) shall receive the flight request and related documents from the flight applicant, implement air traffic flow management in accordance with the procedures, and issue the flight permit on behalf of the CAA.
1.5 Flight traffic, airspace and airport capacity in Mongolian airspace shall be taken into account when planning and issuing permits for air traffic.
1.6 Prior to carrying out a flight in accordance with the permission, the flight applicant is required to submit his/her flight plan to the Air traffic flow management division and other relevant departments in accordance with ENR 1.10 and ENR 1.11.
1.7 The permission for international flight is valid for 72 hours after the beginning of flight operation.
1.8 The permission for domestic flight is valid for 48 hours after the beginning of flight operation.
1.9 The permission for special flight is valid for 24 hours after the beginning of flight operation.
1.10 The permission for overflight shall stay valid during an emergency landing.
1.11 The flight applicant shall be fully responsible for the accuracy and validity of the information on the flight plan, flight request and related documents.
1.12 The flight applicant shall regularly update the information about the changes in the documents required for the flight.
1.13 Flight permits may be refused due to incomplete, inconsistent, expired, invalid, or adverse factors that adversely affect airspace and airport capacity and flight safety.
1.14 Requests for foreign special duty and official flights shall be received by the state central administrative body responsible for foreign affairs, and requests for domestic special duty and official flights shall be received by the State special protection agency.
1.15 Flights of state aircraft shall be regulated in accordance with the law on the use of airspace in flight, the law on state aviation, and the joint procedures for regulating the traffic of special and special duty of state aircraft.
1.16 The airlines in case of flying near the border and air zone of Mongolia, the law on borders of Mongolia, the law on the Use of airspace in flight, the agreement between the Governments of Mongolia and the People’s Republic of China on the Mongolian-Chinese border regime, the agreement on the Russian-Mongolian border regime, other relevant rules and regulations shall apply.
1.17 In the case of flights in protected areas, article 12 paragraph 8 of the Law on Special Protected Areas shall apply.
1.18 Flight operations are governed by relevant civil aviation rules.
1.19 Requests for non-scheduled local commercial flights submitted by the flight applicant (foreign country) shall be granted a flight permit based on the intergovernmental Air Services Agreement concluded with that country.
1.20 Non-scheduled international take-off and landing flight request and its relevant documents submitted by the flight applicant shall be received and decisions will be made whether to grant flight permission or not, considering other factors such as airspace and airport capacity and ground handling information.
1.21 If approval is granted, the date and time of flight may be changed to take into account other factors such as airspace and airport capacity, ground handling information.
1.22 A flight permit may be refused due to incomplete, inconsistent, expired, or invalid documents, airspace and airport capacity, or factors that adversely affect flight safety.
1.23 The CAA is not responsible for the consequences and responsibilities of the flight applicant in the event of a refusal to issue a flight permit due to non-compliance with the flight permit documents.

2. Scheduled flights
2.1 A flight carried out with regular interval according to a publicly announced schedule is considered as scheduled flight.
2.2 The flight applicant shall submit the request for international and local scheduled flights operating in Mongolian airspace at least 30 calendar days before the start of the flight.
2.3 The flight applicant shall submit a request for an international scheduled flight in accordance with the “A” form of the regulation, and a request for a local scheduled flight in accordance with the “C” form at the following addresses.

2.4 Scheduled flight in the airspace of Mongolia is operated based on the permission sent via E-mail and SITA channel and the flight plan /FPL/ will be submitted to Air traffic flow management division and other related services of CAA according to the procedures set forth in ENR 1.10 and ENR 1.11.
2.5 In case of any changes to the flight operation for any reason, the airline shall inform the Air traffic flow management division via AFS addresses ZMUBYAYX, ZMUBZGZX, E-mail and SITA addresses ULNUGOM, ULNKKOM.
3. Non-scheduled flight
3.1 Non-scheduled flights are flights other than scheduled flights.
3.2 Non-scheduled flights shall be operated on the basis of permission issued by Air traffic flow management division on prior request of the flight applicant.

3.3 The request for non-scheduled international flight shall be submitted in accordance with form “B”,
3.4 Request for non-scheduled international flight
3.4.1 The flight applicant shall submit the request for special and VIP flights in accordance with form “B” at least 2 calendar days prior to the beginning of flight operation.
3.4.2 The flight applicant shall submit an international overflight, take-off and landing flight request in accordance with form “B” or the information included in it before 2 working days prior to the beginning of flight operation.
3.4.3 If the flight request is submitted one calendar day before the beginning of flight operation, the air navigation fee will be charged as an extra charge and the flight permit will be issued.
3.4.4 If the flight request is submitted at least 6 hours before the beginning of flight operation, the air navigation fee will be charged as a double extra charge and the flight permit will be issued.
3.4.5 The flight applicant shall submit a flight request for flights by other aircraft, transportation of passengers, delivery of spare parts, navigation equipment and technical inspection in case of special duty, humanitarian, ambulance or aircraft failure due to lack of flight in accordance with form B within 30 minutes prior to the beginning of the overflight operation and 1 hour prior to the beginning of the take-off and landing flight operation.
3.5 Request for non-scheduled domestic flight
3.5.1 The flight applicant shall submit the request for special flight on a civil aircraft in accordance with form “D” before 1 calendar day prior to the beginning of flight operation.
3.5.2 The flight applicant must submit a flight request for flights by other aircraft transportation of passengers, delivery of spare parts, navigation equipment and technical inspection flight in case of failure of special duty, humanitarian, ambulance and aircraft flight in accordance with form D within 30 minutes prior to the beginning of the flight operation.
3.5.3 The flight applicant shall submit the request for special flight on a state aircraft in accordance with form “D” before 2 days prior to the beginning of flight operation.
4. Flight changes
4.1 Scheduled flight
4.1.1 Requests for 5 or more regular changes or additional flights to the approved international and domestic scheduled take-off and landing flight schedule shall be submitted to the Schedule Board.
4.2 Scheduled overflight changes
4.2.1 In case of adding a single flight to/from the scheduled overflight planning, the flight applicant shall submit the flight request in accordance with form “B” or the information included in it before 2 working days prior to the beginning of flight operation.
4.2.2 In the event of a one-time change into the scheduled overflight planning, the flight applicant shall submit the changes at that time.
4.2.3 The flight applicant shall submit two or more regular changes into the scheduled overflight planning and an additional flight request in accordance with form “A” or the information included in it at least 5 working days prior to the beginning of flight operation.
4.3 International scheduled take-off and landing flight changes
4.3.1 In the event of a single change in the take-off and landing flight planning, the flight applicant shall submit the flight request with the relevant explanation at least 1 hour prior to the beginning of flight operation.
4.3.2 The flight applicant shall submit 2-4 changes to the approved scheduled flight plan and requests for additional flights in accordance with the form "A" before 5 working days prior to the beginning of flight operation.
6. General purpose flight
6.1 In case of flight in uncontrolled airspace, the flight plan shall be submitted to the Air Traffic Services Authority in accordance with the Civil Aviation Rules.
6.2 The aircraft owner shall be responsible for the safety of the flight of the general purpose aviation operation.
6.3 In case of flights from uncontrolled airspace to controlled airspace, or from controlled airspace to uncontrolled airspace, the flight request shall be submitted to ATFMD in accordance with the regulation.
